1. Overview of the Service

Biznalyst is an AI-powered business intelligence and marketing analytics platform that processes your business transaction data to generate insights, analyses, and reports. The Platform includes data ingestion tools, segmentation frameworks, AI-orchestrated analytics, and downloadable or shareable reports.

Biznalyst does not modify data in your source systems (such as Shopify) and operates solely as an analytical tool.

2. Eligibility

You must be at least 18 years old to use Biznalyst. If you are accessing Biznalyst on behalf of a business, you confirm that you have the authority to bind that entity to these Terms.

3. Account Registration & Security

You must create an account to use Biznalyst. You agree to:

• Provide accurate and complete information

• Maintain the confidentiality of your login credentials

• Promptly update any information that changes

• Notify Biznalyst immediately if you suspect unauthorized access

You are responsible for all activity that occurs under your account.

4. Use of the Platform

You agree not to:

• Use Biznalyst in violation of any applicable laws

• Reverse engineer, decompile, or attempt to extract source code

• Access the Platform using automated scripts or bots (except authorized integrations)

• Upload unlawful, harmful, or malicious data

• Attempt to gain unauthorized access to the Platform or underlying infrastructure

Biznalyst may suspend or terminate access for violations of these Terms.

5. Data You Provide

You retain ownership of all data you upload or connect to Biznalyst (“Your Data”).

By using the Platform, you grant Biznalyst a limited, revocable, non-exclusive license to process Your Data solely for:

• Providing analytics and reports

• Operating and improving the Platform

• Ensuring accurate billing

• Troubleshooting and customer support

Biznalyst does not sell Your Data or use it to train external AI models.

You are responsible for ensuring you have the necessary rights and permissions to provide Your Data to Biznalyst.

6. AI-Driven Analysis

Biznalyst uses AI orchestration to interpret user questions and run analytics tools. You understand and agree that:

• AI outputs depend on the quality and completeness of Your Data

• AI-generated insights may contain inaccuracies, and should not be the sole basis for major business decisions

• Biznalyst provides tools and insights but does not guarantee business outcomes

Biznalyst does not ingest your raw customer-level data into external AI models.

7. Subscription, Billing & Credits

7.1 Free Trial

New users receive a 15-day free trial (up to 50 credits). After the trial ends, paid subscription is required to continue using the Platform.

7.2 Credits

Each interaction with the Biznalyst agent consumes credits. You can monitor credit usage in the “Usage History” section.

7.3 Payment Methods

• Shopify users: Billing is handled through Shopify Billing.

• Other users: Payment is arranged through direct invoicing or supported payment processors.

7.4 Renewal & Cancellation

Subscriptions renew automatically unless cancelled. You may cancel at any time via your account settings or Shopify Billing. Cancellation stops future charges but does not refund previously paid fees.

7.5 Non-Payment

Failure to pay may result in suspension or termination of access.

8. Intellectual Property

Biznalyst owns all rights to:

• The Platform

• Analysis tools

• AI orchestration logic

• Reports, templates, and visualizations created by Biznalyst (excluding Your Data)

• Logos, branding, and trademarks

Except as explicitly allowed, you may not reproduce, resell, or distribute Biznalyst content or software.

9. Availability & Service Levels

Biznalyst aims to maintain reliable access, but we do not guarantee:

• Uninterrupted service

• Error-free performance

• Preservation of all data without loss

We may temporarily suspend the Platform for maintenance or upgrades.

10. Third-Party Integrations

If you connect Biznalyst to third-party platforms (e.g., Shopify):

• You authorize Biznalyst to access necessary data

• Your use of third-party services is governed by their terms

• Biznalyst is not responsible for issues arising from those services

11. Data Privacy

Biznalyst handles Your Data in accordance with the Privacy Policy. By using Biznalyst, you agree to the handling of information as described in that policy.

12. Termination

You may stop using Biznalyst at any time. We may suspend or terminate your access if:

• You violate these Terms

• You fail to pay subscription fees

• We discontinue the Platform

Upon termination:

• Your access to the Platform will cease

• You may request deletion of Your Data

• Certain obligations (payment, confidentiality, indemnification) survive termination

13. Disclaimer of Warranties

Biznalyst is provided “as is” without warranties of any kind. We do not guarantee:

• Accuracy of insights or AI-generated content

• Financial or business outcomes

• That the Platform is free of errors, vulnerabilities, or downtime

Use of Biznalyst is at your own discretion and risk.

14. Limitation of Liability

To the maximum extent permitted by law, Biznalyst is not liable for:

• Loss of profits or revenue

• Business interruption

• Data loss

• Indirect, incidental, or consequential damages

Biznalyst’s total liability for any claim is limited to the amount you paid in the preceding 12 months.

15. Indemnification

You agree to indemnify and hold Biznalyst harmless from claims, damages, or losses resulting from:

• Your use of the Platform

• Violations of these Terms

• Your Data or misuse of integrations

16. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

17. Governing Law
